Britney Spears suffers another setback in custody battle with Kevin Federline

Britney SpearsBritney Spears suffered a setback in her custody battle with Kevin Federline after his attorney managed to convince a judge he needed more time to review what Britney says in her deposition.

The next hearing was scheduled for January 23, but K-Fed's lawyer, Mark Vincent Kaplan, argued today (18 December) that he needed time to review the deposition to see what Spears says under oath.

Commissioner Scott Gordon agreed with Kaplan, and pushed the hearing back till February 19. It has been reported by a celebrity website that Britney's lawyers wanted to convince the commissioner to allow her the right to drive with her kids and also wanted more custody rights for the January 23 court date.

But that will have to wait till February 19 - meaning Kevin Federline still has custody of sons, Sean Preston, 2 and Jayden James, 1.

The troubled pop star, 26, missed the original deposition at Kaplan's office due to illness.

The deposition was demanded to determine whether Britney misused alcohol and substances in front of her young children.

Statements were taken from Britney's ex-manager Larry Rudolph in her absence, before the court learned that Britney had 'general illness' and would not be showing up.

K-Fed's lawyer, Mark Vincent Kaplan spoke after she failed to show because of her illness. He said: "I was told of a general medical condition, and Spears felt she couldn't attend."

Britney's next deposition date is set for the first week of January at an unknown location.
