Britney Spears to sue photographer over OK! magazine photos

Britney Spears - OK! MagazineBritney Spears is reportedly set to sue photographer Dani Brubaker, the photographer who took family portraits of the troubled singer and her two sons Sean and Jayden in November - and sold them to OK! magazine for a reported fee of $1million.

Britney is believed to be seeking the services of top legal litigator Howard Weitzman to sue Brubaker for selling the pictures. They are expected to claim that while Brubaker didn't sign a confidentiality agreement and has the copyright to the images, there were "numerous e-mails and text messages that explicitly state the pictures were never to be made public."

According to PageSix.com, when Brubaker was approached by media outlets about the pictures in December, she issued a statement declaring that her "integrity wasn't for sale," and that despite having been offered $500,000 for the pictures at the time, she would not budge - but he changed her mind, however, when her manager became involved and struck a deal with OK!.

A source said that since the pictures were published in OK! - Britney removed the from her house because she felt like she had been betrayed and "kicked in the gut by Dani." When Brit's camp finally got through to Brubaker (after the deal with OK! was done), insiders say that the photographer offered no apologies for selling the pictures.

Though Brubaker has said she will donate the proceeds to a children's charity, there is no confirmation of this having taken place yet. Regardless of Brubaker's intentions, the source added that "all legal options are being explored at this time. Brubaker must be dealt with, and Britney will absolutely proceed in the very least to sue her."

Brubaker's rep was not returning calls for comment.
