Lawyer wants Britney Spears hearing moved

Britney SpearsBritney Spears' conservatorship case could be on the move, if a lawyer gets his way.

NYC based attorney Jon Eardley claims the troubled pop princess cannot get a fair hearing if the case remains in Los Angeles. In legal papers, filed in Federal Court, the lawyer asks for the case to be taken away from LA Superior Court.

In the documents, Eardley claims Britney's rights have been snatched away from her and she has been cut off from life. "It is doubtful that Ms. Spears can receive equal protection and a fair trial or hearing in the custody proceedings because of the intense media scrutiny of what would normally be private aspects of a person's life," the papers state.

Eardley apparently wants an injunction issued in federal court, asking the judge for the power to protect Britney in her custody case as well.

The documents allege "the deprivation of her civil liberties by the conservator is so severe as to interfere with the effectiveness of the scheduled medications that are covered by the Food, Drug and Cosmetics Act."

At a court hearing on Thursday, a judge ruled that power of attorney over Britney Spears' estate should remain in the hands of her father. The commissioner ruled that 'current orders are still in effect' - meaning Brit's conservators, Jamie Spears and Andrew Wallet still have the power to deal with her financial issues.

Commissioner Goetz extended the conservatorship order until March 10 - the date of the next hearing. Bryan Spears, Britney's older brother was also named as the trustee of his sister's trust. Brian, 30, and attorney Ivan Taback were named successor co-trustees, meaning that they both assume control.
