Paul McCartney, Heather Mills unable to reach an agreement; judge to dictate settlement

Heather Mills and Paul McCartneyEmbattled former couple Paul McCartney and Heather Mills have not been able to reach an agreement in their bitter High Court divorce case - and a judge will now dictate a settlement, according to the AP.

Former glamor model Mills has been representing herself in the case since splitting from her law firm late last year after she failed to pay them. This is believed to be the reason that hearing - originally penned in for five days, had been extended.

While she returned to London's High Court Monday morning after the case overran last week, Paul, 65, was not present. After court let out, one of Paul's attorneys told the media that the judge had reserved his ruling in the case, according to the AP, which means it will be left to the court to determine a settlement and give his ruling at a later stage.

If either side appeals the decision, the case will be held in open court, whereas now, the case is being conducted behind closed doors.

The former couple married in 2002 and separated in 2006. Heather was Paul's second wife. His first wife, Linda, died of cancer in 1998.

It was reported earlier that Heather had agreed to destroy the evidence she had accumulated about Sir Paul's wealth - estimated to be around $1.6bn - and has also pledged to get rid of all video and audio evidence on their four-year marriage.

Mills, dubbed Mucca by British tabloids due to her questionable past, has previously claimed to have a tape of Sir Paul confessing to hitting his late wife Linda.

Sir Paul is determined Mucca should be banned from talking about any aspect of their marriage but she isn't likely to accept gagging order. This is probably what's causing the delay.

A source told the press earlier today: "Heather doesn't want to be banned from talking about her marriage and Paul doesn't want damaging details leaking out."
